INTRODUCTION TO THE COURSE

This course is a 2-month certificate course on the Prevention of Sexual Harassment at Workplace as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 or POSH Act.

The course aims to make students aware of all aspects of preventing sexual harassment at the workplace. It will provide knowledge about what constitutes sexual harassment, the rights and remedies available to complainants, formation and functioning of Internal Complaints Committees (ICCs) in organizations to address complaints, timelines for resolving complaints and more.

Taking this course will help students gain expertise in identifying and stopping instances of sexual harassment. It will also help organizations and HR professionals to establish anti-harassment mechanisms and ensure compliance with the POSH Act.

The syllabus covers 4 chapters – introduction to the POSH Act, understanding workplace sexual harassment and what it entails, formation and role of ICCs, and the complaint resolution process that ICCs need to follow.

For example, let’s consider a scenario where a female employee, Ms. X, has been facing inappropriate comments and gestures from her colleague Mr. Y for the past few months. After completing this course, Ms. X will understand that this behaviour constitutes sexual harassment. She will know her rights and be able to file a formal complaint with the ICC set up in her organization as per the POSH Act. The ICC will then take necessary actions to resolve the complaint in a timely manner as prescribed in the Act.

MODULE 1: INTRODUCTION TO THE ACT

This module provides an in-depth understanding of the historical context of the fight against sexual harassment in India. Participants will be introduced to The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, exploring its key provisions and implementation in organizations.

MODULE 2: WORKPLACE SEXUAL HARASSMENT

Participants will learn about the definition of the workplace, identifying an aggrieved woman, and understanding the elements that constitute sexual harassment. The module also covers the rights and remedies available to complainants who have experienced workplace sexual harassment.

MODULE 3: FORMATION OF ICC

This module focuses on the formation of Internal Complaints Committee (ICC), including member selection and the role of external members. Participants will gain insights into the ICC's compliance obligations under the Act and strategies for implementing and monitoring recommendations within the organization.

MODULE 4: HEARING OF COMPLAINTS BY ICC

Participants will explore mechanisms for protection from sexual harassment, conduct of disciplinary proceedings, timelines for deciding on complaints, the complaint filing process, responses by the accused, settlement options, interim measures, and recommendations by the ICC.

MODULE 5: ROLES AND RESPONSIBILITIES

This module offers a detailed examination of the roles and responsibilities involved in preventing and addressing workplace sexual harassment. Guidelines for employers, employees, and ICC members will be discussed, along with best practices for fostering a safe and respectful work environment.

MODULE 6: TRAINING AND AWARENESS PROGRAMS

Participants will learn to design and implement effective training programs on preventing sexual harassment. The module covers the role of awareness campaigns, employee education, and regular updates to ensure a well-informed and proactive approach to preventing harassment.

MODULE 7: CONFIDENTIALITY AND NON-RETALIATION

This module emphasizes the importance of maintaining confidentiality in sexual harassment cases. Participants will learn to create a safe reporting mechanism, protect complainants and witnesses from retaliation, and understand the legal aspects and consequences of breaching confidentiality.

MODULE 8: PREVENTIVE MEASURES AND POLICIES

Participants will explore the development of robust anti-sexual harassment policies, proactive measures for prevention, internal complaint resolution procedures, and the importance of regular audits and evaluations of policies and procedures.

MODULE 9: REPORTING AND DOCUMENTATION

The module covers the importance of prompt and accurate reporting, documentation of complaints and investigations, maintaining confidentiality during documentation, and the record-keeping requirements mandated by the Act.

MODULE 10: POST-INVESTIGATION ACTIONS

Participants will understand the ICC's role in recommending actions post-investigation, disciplinary consequences for proven cases, rehabilitation measures for the accused, and ongoing support for complainants, ensuring a harassment-free workplace.

MODULE 11: GENDER SENSITIZATION AND DIVERSITY INCLUSION

This module focuses on promoting gender sensitivity, encouraging diversity and inclusion as preventive measures, addressing unconscious biases and stereotypes, and fostering a workplace culture grounded in respect and equality.

MODULE 12: CASE STUDIES

Through analysis of landmark court cases and industry-specific examples, participants will gain practical insights into handling sexual harassment cases. Lessons learned from successful and unsuccessful case resolutions will be discussed, providing valuable guidance

ASSIGNMENTS AND EXAMINATION

EXAMINATION

The schedule for the examination will be released at the end of the second month of the course. This will give you ample time to prepare and review the course material thoroughly. The examination will be of 50 marks and will comprise multiple-choice questions (MCQs) and situation-based questions and answers. This format is designed to test not only your recall of the course content but also your ability to apply the concepts in various scenarios.
More about the assignments and examination shall be mentioned in the course guidelines provided after successful registration of the course and students shall be informed during the live sessions of the course as well.
