To address this gap, LawLearnizo is launching its Certificate Course on Civil Drafting – Practice and Procedure.

Spread over 3 months, the course integrates theory with hands-on practice to help students develop vital drafting skills. Students will learn to draft plaints, written statements, applications and other documents that form the core of civil litigation process. Interactive lessons will cover the structure, format and language used in different legal documents. Students will also gain insights into managing court files and coordinating with court staff.

To demonstrate the real-world relevance, consider this scenario. A property dispute has emerged between two neighbours regarding the boundary wall. One neighbour alleges encroachment and files a suit for injunction and damages. As a junior associate at a law firm, a student may be tasked with drafting the written statement on behalf of the defendant. The knowledge and skills gained from this course will help the student to methodically respond to the plaint allegations, cite relevant case laws and statutes, and defend the client’s case effectively.

MODULE 1: LITIGATION DRAFTING

MODULE 2: LEGAL NOTICE

Participants will delve into the intricacies of issuing legal notices, understanding their importance, benefits, and the requirements for a legally effective notice. The module also covers the art of crafting responses to legal notices, including templates for both legal notices and replies.

MODULE 3: PLAINT

This module provides a detailed exploration of drafting a plaint in a civil case, covering topics such as amendments, jurisdiction, filing procedures, and the essential components of a plaint. Participants will gain practical skills through a detailed template for drafting a plaint.

MODULE 4: WRITTEN STATEMENT, SET-OFF, COUNTER CLAIM

Participants will learn the nuances of preparing a written statement, exploring characteristics, filing procedures, and the inclusion of set-offs and counterclaims. The module distinguishes between set-off and counterclaim, offering a comprehensive template for drafting a written statement.

MODULE 5: REPRESENTATIVE SUIT-ORDER I RULE 8

This module introduces the concept of representative suits under Order I Rule 8 of the CPC, examining its purpose, procedures, and distinctions from other legal actions. Participants will gain practical insights through a template for drafting representative suits.

MODULE 6: AMENDMENT OF PLEADINGS

Participants will understand the importance of amendments in civil suit pleadings, exploring rules, procedures, and reasons for allowing amendments. The module covers the doctrine of relation back and provides a template for filing amendments in pleadings.

MODULE 7: REJECTION OF PLAINT

This module navigates through the grounds and procedures for the rejection of plaints under Order VII Rule 11, clarifying the distinction between dismissal and rejection. Participants will gain practical insights through a template for handling the rejection of plaints.

MODULE 8: EX-PARTE PROCEEDING

Participants will learn about ex-parte proceedings under Order IX Rule 6, covering the implications of non-appearance, setting aside ex-parte decrees, and the grounds for doing so. The module includes templates for Order IX Rule 9 and Rule 13 applications.

MODULE 9: TEMPORARY AND INTERIM INJUNCTION

This module explores the nuances of obtaining temporary and interim injunctions, covering principles, applications under Order XXXIX Rule 1, and templates for drafting injunctions, including those restraining nuisance.

MODULE 10: TRIAL AND EVIDENCE

Participants will delve into the intricacies of trial and evidence, exploring burden of proof, standards, cross-examination, and the admissibility of oral, document, and electronic evidence. The module provides practical guidance on drafting applications related to evidence.

MODULE 11: ARGUMENTS AND HEARING

This module guides participants through court procedures and strategies during arguments, emphasizing the framing of effective arguments and concluding with final arguments in civil cases.

MODULE 12: EXECUTION PETITION

Participants will gain insights into the execution of judgments, covering the jurisdiction, application procedures, modes, and limitations. The module includes practical templates for executing orders under Order XXI.

MODULE 13: DRAFTING OF FIRST APPEAL

This module provides a comprehensive overview of the appellate process, focusing on the drafting of a first appeal. Participants will gain insights into the nature of a first appeal, the parties eligible to prefer appeals in higher courts, and practical skills in drafting a first appeal through a template.

MODULE 14: REVIEW PETITION

Participants will explore the intricacies of filing a review petition, covering its overview, purpose, and the essential elements of a review petition. The module includes a template for drafting a review petition, offering practical guidance for legal professionals.

MODULE 15: REGULAR SECOND APPEAL

This module delves into the nuances of a regular second appeal, examining its nature and the distinctive aspects of second appeals. Participants will learn the essentials of drafting a regular second appeal through a practical template.

MODULE 16: IBC (INSOLVENCY AND BANKRUPTCY CODE)

This module provides a comprehensive understanding of the Insolvency and Bankruptcy Code (IBC), including its overview, distinctions between financial and operational creditors, and the procedural aspects of IBC matters. Participants will gain practical skills in drafting IBC notices, with templates provided for Form F and Forms 1-6.

MODULE 17: CONSUMER COMPLAINT

Participants will learn the essentials of consumer complaint proceedings, including its overview, grounds for filing, and the procedural aspects of filing a consumer complaint. The module provides practical guidance through a template for drafting a consumer complaint application.

MODULE 18: RIGHT TO INFORMATION (RTI)

This module explores the Right to Information (RTI) framework, guiding participants on drafting effective RTI applications. Participants will learn about important fields to cover, dos and don'ts, restrictions on disclosed information, and the step-by-step process of filing an RTI application. Practical insights are provided through an RTI application template.

MODULE 19: RELATIONS WITH COURT CLERKS, READERS, COLLEAGUES, AND INTERNS

This module focuses on the professional conduct and ethical responsibilities of lawyers towards court clerks, readers, colleagues, and interns. Participants will gain insights into maintaining positive relationships within the legal profession, understanding duties, and avoiding professional misconduct.

MODULE 20: BONUS TEMPLATES

This module offers a collection of bonus templates covering various legal documents, including simple affidavits, applications for issuing summons to witnesses, conveyance of immovable property, leave and license agreements, notices under the Transfer of Property Act, applications for revision, restoration of suits, notices to arbitrators, applications under the Arbitration and Conciliation Act, and templates for specific legal scenarios like waiving off the waiting period in Hindu Marriage Act and suits for specific performance. Participants will receive practical templates to assist in drafting diverse legal documents.

ASSIGNMENTS AND EXAMINATION

ASSIGNMENTS

To ensure a consistent learning pace and to keep you engaged with the course material, we will provide two assignments every week. This means you will receive a total of 24-48 assignments throughout the course duration. These assignments are carefully crafted to reflect the topics discussed during the live sessions each week, allowing you to apply the concepts learned in a practical manner.

EXAMINATION

The schedule for the examination will be released at the end of the second month of the course. This will give you ample time to prepare and review the course material thoroughly. The examination will be of 50 marks and will comprise multiple-choice questions (MCQs) and situation-based questions and answers. This format is designed to test not only your recall of the course content but also your ability to apply the concepts in various scenarios.
More about the assignments and examination shall be mentioned in the course guidelines provided after successful registration of the course and students shall be informed during the live sessions of the course as well.

Within the first seven days of registration, the students are eligible for an 80% refund, and within the first 14 days, they are eligible for a 60% refund.

Within 3-5 days, a refund confirmation email with the amount of the refund will be delivered.

The live lectures have a scheduled time and dates of the course are revealed one or two days prior to the start of the course. You can take the backup classes in case you miss any live class for that particular lecture.
